Terms & Conditions
These Terms and Conditions (“Terms”) govern the relationship between Luxa Elite Travel (“Agency,” “we,” “us,” or “our”) and you, the client, traveler, or purchaser (“Client,” “you,” or “your”). By requesting an itinerary, authorizing a deposit, paying a planning retainer, or booking travel through Luxa Elite Travel, you agree to be bound by these Terms. Luxa Elite Travel acts solely as an independent travel concierge and booking intermediary for disclosed third-party suppliers (including boutique hotels, private villas, commercial and charter airlines, yacht purveyors, ground transport, private chefs, and tour operators—collectively, “Suppliers”). Luxa Elite Travel is not the direct provider of these travel services.
Cancellation Notice
All cancellation requests must be submitted in writing and are governed by individual Supplier policies, which may result in partial or total loss of funds. In addition to any non-refundable Supplier penalties, Luxa Elite Travel applies administrative service fees: Custom Itinerary Cancellation — $150 per booking; Ultra-Luxury / Premium Concierge Cancellation — $250 per booking. Unused portions of custom itineraries, private transfers, or luxury packages are non-refundable once travel has commenced.
Client Authority: You warrant that you are at least 18 years of age, possess the legal authority to enter into this agreement, and accept financial responsibility for all transactions made under your name or on behalf of members of your travel party.
Accurate Information: You warrant that all details provided for yourself and your party are complete, true, and accurate. Speculative, false, or fraudulent inquiries or reservations are strictly prohibited.
Supplier Contracts: All travel documentation, vouchers, and bookings are issued subject to the specific terms, conditions, cancellation rules, and tariffs of each individual Supplier. By approving an itinerary, you agree to abide by the terms imposed by each selected Supplier.
Independent Arrangements: Luxa Elite Travel is not responsible for any logistics, flights, accommodations, or activities booked independently by the Client. We cannot assist with modifications, delays, or losses stemming from self-booked travel. Loyalty or frequent flyer points redemption cannot be guaranteed for itineraries curated by Luxa Elite Travel.
All rates, luxury amenities, and Supplier promotions are subject to availability and currency exchange fluctuations until fully confirmed. Luxa Elite Travel reserves the right to correct pricing errors, omissions, or miscalculations. In the event of a material carrier or Supplier price adjustment prior to confirmation, we reserve the right to adjust client pricing accordingly.
Payment Authorization: By submitting credit card details or payment authorizations, you authorize Luxa Elite Travel and/or the designated Suppliers to process charges for your travel arrangements.
Professional Fees: Retainers, design fees, and concierge planning fees paid directly to Luxa Elite Travel are 100% non-refundable compensation for work performed, expertise, and research, regardless of whether a trip is taken, modified, or canceled.
Supplier Deadlines: Failure to adhere to payment schedules set by Suppliers or Luxa Elite Travel may result in automatic cancellation of bookings and total forfeiture of deposits.
No Chargeback Agreement: Except in clear cases of unauthorized credit card fraud, you agree not to initiate a chargeback or payment dispute with your credit card company or bank to bypass cancellation penalties or fee agreements. You agree to reimburse Luxa Elite Travel for all legal fees, collection costs, and administrative expenses incurred in resolving improper chargebacks.
Cancellation Requests: All requests to cancel or modify a confirmed itinerary must be submitted to Luxa Elite Travel in writing.
Supplier Penalties: Cancellations and changes are governed by Supplier policies and may result in partial or total loss of funds paid.
Agency Administrative Cancellation Fees: In addition to any non-refundable Supplier penalties, Luxa Elite Travel applies the following administrative service fees for processing trip cancellations:
Custom Itinerary Cancellation: $150 per booking
Ultra-Luxury / Premium Concierge Cancellation: $250 per booking
Unused Services: Unused portions of custom itineraries, private transfers, or luxury packages are non-refundable once travel has commenced.
Passport & Visa Responsibilities: Clients are solely responsible for securing valid passports, entry visas, health declarations, and transit permits required by foreign governments. Passports must typically be valid for at least six (6) months beyond your scheduled return date and contain sufficient blank pages.
Name Matching: The full legal name, date of birth, and gender provided to Luxa Elite Travel must match government-issued travel IDs (such as passports) exactly. Discrepancies may result in denied boarding or costly re-issuance charges, for which Luxa Elite Travel bears no financial liability.
Travel Document Review: You are required to review all travel vouchers and documents within 24 hours of receipt. If errors are not reported to Luxa Elite Travel in writing within 24 hours, any correction fees will be the sole responsibility of the Client.
Border Control & Criminal History: Individual nations maintain full discretion over border entry. Individuals with past criminal records (including DWIs) or legal restrictions must verify entry rules directly with target country embassies prior to booking.
Strong Recommendation: Luxa Elite Travel strongly recommends that every traveler purchase comprehensive Travel Insurance covering trip cancellation/interruption, emergency medical evacuation, medical care, baggage protection, and "Cancel for Any Reason" (CFAR) coverage.
Insurance Limitation: Luxa Elite Travel is not a licensed insurance broker and cannot interpret policy details or guarantee claim approvals.
Insurance Waiver: If you decline travel protection, you assume 100% financial liability for any non-refundable cancellation fees, medical costs, emergency transport, or flight disruptions. Declining coverage constitutes a full release of Luxa Elite Travel for losses that insurance would have covered.
Health Requirements: Clients are responsible for verifying and fulfilling all vaccination, health screening, and medical entry criteria for their destinations.
Government Advisories: Clients are encouraged to monitor travel advisories via official sources (such as state.gov and cdc.gov) and register trips with state department programs (such as STEP). Luxa Elite Travel does not warrant that travel to any specific destination is advisory-free or without risk.
Inherent Risks: Luxury travel, private excursions, adventure sports, watercraft charters, and visits to remote regions carry inherent risks. You acknowledge that physical activities can aggravate pre-existing conditions and voluntarily assume all risks (including personal injury, illness, property damage, or death) associated with your itinerary.
Alcohol & Substance Use: If you participate in excursions or activities while under the influence of alcohol or non-prescribed controlled substances, YOU ASSUME FULL RESPONSIBILITY AND LIABILITY for any injury, accident, or property damage that occurs, and agree to indemnify Luxa Elite Travel from any resulting claims.
Luxa Elite Travel acts solely as an intermediary for disclosed Suppliers.
LUXA ELITE TRAVEL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE ACTS, OMISSIONS, NEGLIGENCE, BANKRUPTCY, INSOLVENCY, CANCELLATIONS, OVERBOOKINGS, OR FINANCIAL DEFAULTS OF ANY THIRD-PARTY SUPPLIER.
To the maximum extent permitted by applicable law, any financial recovery against Luxa Elite Travel for claims arising from our planning services shall be strictly capped at the total amount of commissions or design fees actually received by Luxa Elite Travel for that specific booking.
Luxa Elite Travel shall not be held liable or deemed in breach of contract for failure or delay in performing its planning obligations due to events beyond its reasonable control, including: acts of God, extreme weather events, volcanic disruptions, natural disasters, war, terrorism, civil unrest, strikes, government restrictions, quarantines, epidemics, or widespread communication outages. Supplier refund policies during Force Majeure events shall govern all booking returns.
Clients are expected to maintain high standards of conduct and observe local laws, dress codes, and Supplier rules. Suppliers and Luxa Elite Travel reserve the right to decline service or remove any traveler whose behavior endangers themselves or others, causes property damage, or disrupts the safety and enjoyment of a tour or stay. In such cases, no refunds will be issued, and the Client will be responsible for all return transport costs and property damage claims.
These Terms are governed by and construed in accordance with the laws of the State of [Your State]. You consent to the exclusive jurisdiction and venue of the courts located in [Your County, Your State] for any legal dispute arising from your relationship with Luxa Elite Travel.
Time Limit on Claims: Any claim against Luxa Elite Travel must be filed in writing within twelve (12) calendar months following the completion date of the trip.
Class Action Waiver: You agree to bring any claims against Luxa Elite Travel strictly in your individual capacity and expressly waive any right to participate as a plaintiff or class member in any class action, joint proceeding, or representative lawsuit.
If any provision of these Terms is deemed invalid or unenforceable, that specific provision shall be replaced by a valid provision that most closely reflects the original intent, while all remaining terms remain in full force. These Terms constitute the entire agreement between the Client and Luxa Elite Travel.
Luxa Elite Travel is an independent affiliate of Fora Travel. We act solely as a concierge and booking intermediary for disclosed third-party suppliers and are not the direct provider of travel services.
